The Bar Chamber of Montenegro held the second ENEMLOS training
The Bar Chamber of Montenegro held a second training for the students of the Faculty of Law of the University of Montenegro as participants of the ENEMLOS legal clinic on March 10, 2023 in the premises of the faculty.
The training was carried out by Rusmin Nikoćević and Dr Nina Radulović, attorneys at law from Podgorica.
At the training, the material that was covered during the first training by BCoM and the same lecturers was recapitulated, especially bearing in mind that the majority of the participants of the legal clinic have changed in the meantime.
So, within the first training block, the following topics were recapitulated:
Proper conducting of interviews with clients;
Proper handling of the factual and legal circumstances of the case by the attorney at law, including evidence management;
Proper communication with all participants in the court proceedings; and
Proper assessments of the acceptability of taking the legal case into work due to financial and other benefits,
and all of that through the prism of a specific case from the legal practice.
In the second block of the training, a new real case from legal practice related to the same area of substantive law covered in the previous training (the "dangerous thing") was presented to the participants of the legal clinic, and new topics important for this practice were explained, namely:
Revealing the "truth" in the context of the proper conduct of the procedure;
"Promising success in the dispute" to the party;
Methods of determining the "price" for the provided legal assistance;
In-depth analysis of the case (factual and legal situation, with special reference to the legal basis, passive legitimization of the opposing party, and the role of the party in the proceedings who is represented by the attorney).
In the third block of the training, through the subjective experience of a fictitious trial by an attorney, the following topics were expanded:
Free judge's conviction;
The "luck" factor for success in the procedure;
The importance of assessing the time in which the disputed case took place from the point of view of factual circumstances and applicable law;
The current legal framework as a product of current policies.
BCoM will hold three more ENEMLOS trainings.
